La Secretaría de Comercio Interior de la Nación imputó administrativamente a la empresa Havanna por presunta publicidad engañosa e incumplimiento de oferta.
La Secretaría de Comercio Interior de la Nación, a través de la Dirección Nacional de Defensa del Consumidor y Arbitraje en Consumo, imputó administrativamente a la empresa Havanna por presunta publicidad engañosa e incumplimiento de oferta en sus cuentas verificadas de redes sociales.
La compañía realizó publicaciones en las que ofrecía una caja navideña con productos de la marca a todos aquellos que compartieran su número de CUIL y posteriormente, pasadas más de dos horas, expresó que se trataba de un engaño en conmemoración del Día de los Inocentes.
De esta manera, Havanna habría infringido el artículo 4° de la Ley de Defensa del Consumidor (N°24.240), ya que la publicidad en su conjunto contiene información falsa sobre el ofrecimiento de productos y no cumple el deber de brindar información cierta, clara y detallada.
Por otro parte, estas publicaciones también infringirían el artículo 7° de la Ley 24.240 que prevé las condiciones en las que se tiene que establecer una oferta o promoción. En ningún momento se establecen las bases de la promoción ofrecida por Havanna y no presenta fecha de inicio ni de finalización de la misma, como obliga la ley.
Finalmente, el artículo 4° de la Ley 24.240 también contempla como información que debe brindarse lo establecido por el artículo 6° de la Ley 24.788 de Lucha contra el Alcoholismo que determina que en cualquier publicidad que contenga bebidas alcohólicas tiene que tener visible la leyenda “Beber con moderación. Prohibida su venta a menores de 18 años”. En este caso no se cumpliría tampoco con el deber de brindar información ya que se muestran bebidas alcohólicas y no figura la leyenda correspondiente.
La empresa tiene cinco (5) días hábiles para ofrecer su descargo frente a la Dirección Nacional de Defensa del Consumidor y Arbitraje en Consumo y posteriormente continuará el proceso administrativo para determinar si corresponden sanciones.
